Terms of Service

Terms governing use of Granton Hale websites, funding inquiry flows, and related services.

These Terms of Service ("Terms") govern your access to and use of the Granton Hale websites, application flows, document-upload tools, communications, and related services. By accessing or using our services, you agree to these Terms.

If you are using the services on behalf of a business or other entity, you represent that you have authority to bind that entity, and references to "you" include both you and the entity you represent.

Services and role

Granton Hale operates a business funding and lender-distribution platform. We are not the lender on every transaction, do not guarantee approval, and do not promise any specific offer, rate, timing, amount, or funding outcome.

We may collect information, evaluate fit, route requests to one or more third-party capital providers, assist with document collection, and communicate operational updates, but all financing decisions remain subject to lender underwriting, compliance, documentation, and final approval.

Eligibility and account authority

  • You must be legally capable of entering into binding agreements.
  • You must provide complete and accurate information and keep it current.
  • You must have authority to act for the business or merchant whose information you submit.
  • You may not use the services for unlawful, deceptive, fraudulent, or unauthorized purposes.

Application submissions and representations

You represent and warrant that all information, documents, bank statements, business records, and other materials you submit are truthful, accurate, current, and not misleading. You authorize us to rely on that information and to share it with financing partners, brokers, service providers, and compliance providers as reasonably necessary.

If you submit information on behalf of another person or business, you represent that you have all required permissions and consents to do so.

Communications consent

You consent to receive communications from Granton Hale and its partners by email, phone, and text message regarding your request, operational updates, document needs, servicing matters, and related offers, subject to applicable law. Standard carrier charges may apply.

No guarantee and third-party terms

Submission of an inquiry or application does not guarantee review, approval, offer issuance, statement of terms, funding, renewal, refinancing, or servicing access.

Any third-party lender, broker, funder, bank, or partner may impose its own eligibility rules, disclosures, privacy notices, documentation requirements, servicing terms, fees, and contractual obligations. Once you engage with a third party, its separate terms may apply in addition to ours.

Acceptable use

  • Do not attempt to interfere with, probe, or circumvent system security, access controls, or usage restrictions.
  • Do not use automated tools to scrape, copy, or overload our services without express written permission.
  • Do not submit false identities, altered bank statements, fabricated business information, or misleading attribution data.
  • Do not use the services to violate law, infringe rights, or facilitate fraud, money laundering, sanctions violations, or other prohibited conduct.

Intellectual property

The services, content, branding, software, workflows, design elements, databases, and related intellectual property are owned by Granton Hale or its licensors and are protected by applicable law. Except for the limited right to use the services in accordance with these Terms, no rights are granted to you.

Disclaimer of warranties

To the maximum extent permitted by law, the services are provided "as is" and "as available." We disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and uninterrupted operation.

Limitation of liability

To the maximum extent permitted by law, Granton Hale and its affiliates, officers, employees, contractors, and partners will not be liable for indirect, incidental, consequential, special, exemplary, punitive, or lost-profit damages, or for loss of data, business interruption, or loss of goodwill, arising out of or relating to the services or these Terms.

Where liability cannot be excluded, our aggregate liability will be limited to the greater of one hundred U.S. dollars (US$100) or the amount you paid us directly for the specific service giving rise to the claim during the three months preceding the claim.

Indemnification

You agree to defend, indemnify, and hold harmless Granton Hale and its affiliates, personnel, and service providers from claims, liabilities, damages, losses, and expenses arising out of your submissions, your misuse of the services, your violation of law, or your breach of these Terms.

Suspension and termination

We may suspend, restrict, or terminate access to the services at any time, with or without notice, where we reasonably believe there is fraud, abuse, unauthorized activity, legal risk, technical misuse, or a breach of these Terms.

Governing law (United States)

Except as set out in the following section for users in the United Kingdom, these Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. To the extent permitted by law, any dispute arising from or relating to these Terms or the services must be brought exclusively in the state or federal courts located in New York County, New York, and each party consents to that forum.

Governing law (United Kingdom)

If you access or use the services from the United Kingdom, these Terms and any dispute arising from or relating to these Terms or the services are governed by the laws of England and Wales, and you and we each submit to the jurisdiction of the courts of England and Wales.

Nothing in these Terms limits or excludes any rights you may have as a consumer, or any other statutory rights, that cannot be limited or excluded under applicable United Kingdom law.

Changes to these terms

We may modify these Terms from time to time. The updated version becomes effective when posted, unless a different effective date is stated. Continued use of the services after the effective date of updated Terms constitutes acceptance of the revised Terms.
